TERMS AND CONDITIONS OF PURCHASE

GENERAL

By ordering from the webshop, you accept that the terms and conditions apply between you and Gentaille. The Gentaille brand and webshop are owned, operated and developed by Chateau de Garage AB org.nr: 559496-8512.

The following are our general terms and conditions of sale that apply to the orders and purchases you make through the www.gentaille.com webshop and all subsites of this website.

ORDERING

Ordering products is done via www.gentaille.com. You must be at least 16 years old to place orders and shop at Gentaille. If Gentaille cannot determine your residential address, your order will not be valid. Gentaille also reserves the right to refuse orders in individual cases.

Your order constitutes a request to purchase one or more products from Gentaille. Once you have placed your order, you will receive an email from Gentaille confirming that we have received your order. This confirmation does not mean that your order has been accepted.

All orders must be approved by Gentaille and are subject to availability. Gentaille will send you an email confirming that the product has been sent to you (the delivery confirmation). Only when you receive the Delivery Confirmation will there be a binding contract between you and Gentaille. If we have refused your order or if we have not sent you a delivery confirmation, no contract has been concluded between us. In that case, you are no longer bound by your order. Any advance payments you have made by credit card when placing your order will be refunded to you as soon as possible.

Gentaille reserves the right for possible final sales, stock differences, technical problems, changes of specifications and possible typographical errors on our site.

All attempts at fraud are reported to the police. Gentaille reserves the right to refuse or cancel a purchase if fraud is suspected.

PRODUCT INFORMATION

We always strive to provide the most accurate product information possible. However, deviations may occur in exceptional cases. We therefore recommend that you always check on delivery that the goods correspond to what has been agreed. See further on complaints and right of withdrawal below.

Gentaille endeavors to ensure that the representation of the Products on the Website is as close to reality as possible. However, Gentaille cannot guarantee that all images accurately reflect the true appearance of the products, e.g. Gentaille cannot guarantee that the proportions and colors shown on the website accurately reflect how the garments look in reality. The way colors are reproduced depends, for example, on your screen, your graphics card and your computer settings.

PRICES

Prices on the website are quoted in local currency including VAT. Product, shipping and any discount are listed separately and include any payment fees.

The website contains a number of products and it is always possible that some products may be incorrectly priced. We check prices as part of the shipping routine to you. If a product turns out to be priced lower than the price indicated on the website, you will of course be allowed to buy the product at the correct price. If a product turns out to be priced higher than the price quoted on the website, we will contact you and possibly refuse your order.

Please note that any offers and discounts are only valid on regular priced products (unless otherwise stated). Discounted items are available while stocks last.

PAYMENT

We offer payment by card and Klarna. Payments are handled by our partner Stripe.

DELIVERY AND SHIPPING

Gentaille receives and delivers all orders in the order they are received. Your order will be delivered by DHL or UPS to your nearest agent.

Gentaille reserves the right to make changes with regard to shippers, shipping costs and countries. Available countries and shipping costs are visible when placing the order by the customer.

You will normally receive your goods between 3-5 working days after we receive your order, provided that we can accept your order. We always try to deliver the goods you have ordered within the promised time, but sometimes things can go wrong. If we cannot deliver within the agreed time, we will inform you as soon as possible of the reason for the delay and inform you of a new delivery date.

If the delivery is delayed without us having voluntarily provided you with the above information, please contact us immediately so that we can investigate the reason for the delay.

If any delay is of material importance to you, you may be entitled to cancel the purchase. If it is particularly important to you that you receive the goods within a certain time, please notify us immediately in case of delay. More information on complaints can be found below.

TRANSPORTATION DAMAGE

All shipments sent from Gentaille to you are insured. If you notice any damage to the package before you open it, please contact our customer service immediately.

UNCLAIMED PACKAGE

Your order will remain at the delivery point for around 14 days from the time the package arrives, after which it will be sent back to us. If an order is not collected, or signed for, on time, or if a shipment is returned to Gentaille because the wrong address has been given, we will charge you a fee for shipping, handling and other costs. Please note that not collecting a parcel or not accepting a delivery is not considered an exercise of the right of withdrawal. More information on the return/return policy can be found below.

OPEN PURCHASE AND RIGHT TO EXCHANGE

At www.gentaille.com, all customers are offered open purchase and exchange rights 14 days after you have received your package.

COMPLAINTS

If you consider the goods to be faulty, you can make a complaint. In this case, you should send us a message at customercare@gentaille.com describing the fault, what you want to complain about and why. Remember that you must send the notification within a reasonable time after you noticed or should have noticed the fault. Notification sent within two months of noticing a defect in a product is always considered to be timely.

The right to complain is valid for 3 years.

If the goods have been used, they must be washed before being returned. We will first check whether it is possible to repair the faulty goods; if this is not possible, the goods will be replaced with new goods of the same value. If we cannot replace the goods or repair the fault, you may be entitled to cancel the purchase and get your money back. You may also be entitled to claim damages. All returned goods must be packed in a bag or box. Goods bought at a reduced price are subject to the same conditions as goods bought at a regular price.

All costs you have incurred in connection with the purchase and the complaint will be refunded if the complaint is accepted, e.g. return shipping and extra expenses in connection with the complaint.

In the event of a dispute, Gentaille C/O Chateau de Garage AB refers to the General Complaints Board and we always follow their recommendations.

UNCLAIMED PARCELS

If you as a customer do not collect your parcel from the delivery point, the shipment will automatically be returned to us. For uncollected parcels, we reserve the right to charge a fee of up to 250 SEK/25 EUR to cover return shipping, handling and administration costs.

Please note that an uncollected parcel does not count as an exercise of the right of withdrawal under the Distance Contracts Act. If you want to cancel your purchase, you must first receive the package and then return it in accordance with our return conditions.

FORCE MAJEURE

Gentaille C/O Chateau de Garage AB is exempt from penalties for failure to fulfill certain obligations under this agreement, if the failure is due to an exempting circumstance as set out below and the circumstance prevents, complicates or delays the fulfillment. A circumstance of force majeure shall be deemed to include, inter alia, action or omission by the authorities, new or amended legislation, labor dispute, blockade, fire, flood, sabotage, major accident or other type of natural disaster. force majeure includes government decisions that adversely affect the market and products, such as restrictions in indications, warning texts, sales bans, etc., abnormal decline in the market and if the company is exposed to criminal activity that affects the business.

INTELLECTUAL PROPERTY RIGHTS

The content of the website is protected by copyright belonging to Gentaille C/O Chateau de Garage AB. Photographs, films, illustrations, animations, etc. on the website may not be copied.

APPLICABLE LAW AND DISPUTE

Swedish law applies to these general conditions of purchase.

Of course, we want you as a customer to be satisfied with your purchase from us. We therefore always try to agree with you in the first place on a solution in case something has gone wrong.

If a dispute arises that we cannot resolve together, you can turn to the General Complaints Board.

Disputes can also be heard by the Swedish general court.
