GENERAL

By placing an order from the webshop, you agree to the terms and conditions between you and Gentaille. The trademark and webshop Gentaille is owned, operated and developed by Chateau de Garage AB org.nr: 559496-8512.

Below are our general terms and conditions that apply to the orders and purchases you make via the webshop www.gentaille.com and all subpages to this website.

ORDER

Ordering products is done via www.gentaille.com. You must be at least 16 years old to place orders and shop at Gentaille. If Gentaille cannot determine your residential address, your order will not be valid. Gentaille also reserves the right to refuse an order in individual cases.

Your order constitutes a request to purchase one or more products from Gentaille. When you place your order, you will receive an e-mail message where Gentaille confirms that we have received your order. This confirmation does not mean that your order has been accepted.

All orders must be approved by Gentaille and delivered subject to availability of the product. Gentaille will send an e-mail confirming that the product has been sent to you (delivery confirmation). Only when you receive the delivery confirmation is there a binding agreement between you and Gentaille. If we have rejected your order or if we have not sent you a delivery confirmation, no agreement between us has been entered into. In that case, you are no longer bound by your order. Any advance payments you have made through card payment when ordering will then be refunded to you as soon as possible.

Gentaille reserves the right to any final sales, inventory differences, technical problems, changes to specifications and any typographical errors on our site.

All attempts at fraud are reported to the police. Gentaille reserves the right to refuse or cancel a purchase if fraud is suspected.

PRODUCT INFORMATION

We always strive to provide product information that is as accurate as possible. However, sometimes there might be slight differences. We recommend that you always check upon delivery that the item matches what you agreed on. See more about complaints and right of withdrawal below.

Gentaille strives to ensure that the product images on the website are as close to reality as possible. However, Gentaille cannot guarantee that all images exactly reflect the actual appearance of the products. For example, Gentaille cannot guarantee that the proportions and colors displayed on the website exactly match how the garments look in reality. How the colors are rendered depends on your screen, graphics card, and computer settings.

PRICES

The prices on the website are stated in local currency including VAT. The product price, shipping cost, and any discounts are specified separately and include any payment fees.

The website contains a number of products, and it's always possible that some products may be incorrectly priced. We check the prices as part of our shipping routine to you. If an item turns out to have a lower price than the one stated on the website, you will of course be able to buy the product at the correct price. If a product turns out to have a higher price than the price stated on the website, we will contact you and possibly reject your order.

Please note that any offers and discounts only apply to products at regular prices (unless otherwise stated). Discounted items are available as long as the promotion is running and while stocks last.

PAYMENT

We offer payment by card and Klarna. Payments are handled by our partner, Stripe.

DELIVERY AND SHIPPING

Gentaille receives and delivers all orders in the order they are received. Your order is delivered by DHL or UPS to your nearest delivery point.

Gentaille reserves the right to make changes regarding carriers, shipping costs and countries. Available countries and shipping costs are visible when the customer places an order.

Normally, you will receive your goods within 3-5 business days after we have received your order, provided that we can approve your order. We always try to deliver the goods you have ordered in the promised time, but sometimes things can go wrong. If we cannot deliver within the agreed time, we will inform you as soon as possible about the reason for the delay and inform you of a new delivery date.

If the delivery is delayed without us having provided you with information as above, please contact us immediately so that we can investigate the cause of the delay.

If a possible delay is of significant importance to you, you may have the right to cancel the purchase. Notify us immediately in case of delay if it is particularly important for you to receive the goods within a certain time. More information regarding complaints can be found below.

TRANSPORT DAMAGE

All shipments sent from Gentaille to you are insured. If you discover damage to the package before you open it, please contact our customer service immediately.

UNCLAIMED PACKAGE

Your order will remain at the delivery point for about 14 days from the arrival of the package, after which it will be sent back to us. If an order is not picked up or acknowledged in time, or if a shipment returns to Gentaille due to an incorrect address being provided, we will charge a fee for shipping, handling and other costs. Please note that not picking up a package or not receiving a delivery is not considered an exercise of the right of withdrawal. More information about the return/right of withdrawal can be found below.

OPEN PURCHASE AND EXCHANGE RIGHT

At www.gentaille.com, all customers are offered a 14-day open purchase and exchange right after you have received your package.

COMPLAINT

If you believe that there is something wrong with the item, you have the option to make a complaint. In that case, you should send a message to us at customercare@gentaille.com where you describe the error, what you want to complain about and why. Keep in mind that you must send the message within a reasonable time after you noticed or should have noticed the error. A message sent within two months after you noticed an error in an item is always considered to have been submitted in time.

The right to complain applies for 3 years.

If the item has been used, it must be washed before it is complained about. In the first instance, we investigate whether it is possible to repair the defect on the item, if this is not possible, the item is replaced with a new equivalent item. If we cannot replace the item or remedy the defect, you may, in significant cases, have the right to cancel the purchase and get your money back. You may also have the right to claim damages. All goods that are returned must be packed in a bag or box. The same conditions apply to goods purchased at a reduced price as for goods purchased at the regular price.

All costs you've incurred due to the purchase and complaint will be refunded upon approval of the complaint, such as return shipping and extra expenses related to the complaint.

In the event of a dispute, Gentaille C/O Chateau de Garage AB refers to the General Complaints Board (Allmänna Reklamationsnämnden), and we always follow their recommendations.

UNCLAIMED PACKAGE

If you, as a customer, do not pick up your package from the delivery point, the shipment will automatically be returned to us. For unclaimed packages, we reserve the right to charge a fee of up to 250 SEK/25 EUR to cover the costs of return shipping, handling and administration.

Please note that an unclaimed package does not count as exercising the right of withdrawal according to the Distance Contracts Act. If you want to cancel your purchase, you must first receive the package and then return it in accordance with our return policy.

FORCE MAJEURE

Gentaille C/O Chateau de Garage AB is exempt from penalties for failure to fulfill certain obligations under this agreement, if the failure is due to an exempting circumstance as set out below and the circumstance prevents, complicates or delays the fulfillment. A circumstance of force majeure shall be deemed to include, inter alia, action or omission by the authorities, new or amended legislation, labor dispute, blockade, fire, flood, sabotage, major accident or other type of natural disaster. force majeure includes government decisions that adversely affect the market and products, such as restrictions in indications, warning texts, sales bans, etc., abnormal decline in the market and if the company is exposed to criminal activity that affects the business.

APPLICABLE LAW AND DISPUTES

Swedish law applies to these general terms and conditions of purchase.

We naturally want you, as a customer, to be happy with your purchase from us. Therefore, we always try to agree with you on a solution first if something has gone wrong.

If a dispute arises that we cannot resolve together, you can contact the General Complaints Board (Allmänna Reklamationsnämnden).

If a dispute arises that we cannot resolve together, you also have the option of using the European Commission's online platform for alternative dispute resolution, which you can find at ec.europa.eu/odr. Please note that the platform is intended to provide consumers and businesses with an entry point for examining disputes arising from cross-border e-commerce. As a customer, you have the opportunity to submit complaints in all official EU languages.
Disputes can also be tried by a Swedish general court.
